Commercial Insolvency and Bankruptcy

Our Insolvency & Bankruptcy team has considerable experience of both corporate and personal insolvency including acting for or against companies and individuals in financial distress.

We also regularly act for liquidators, administrators, directors, creditors and trustees in bankruptcy.

Our work for liquidators and trustees is often to assist with the realisation of assets of bankrupt estates and of insolvent companies. This may involve proceedings against third parties, e.g. company directors for the return of monies inappropriately paid to them out of company assets, advising on preferences, transactions at an undervalue, wrongful or fraudulent trading and director disqualification. We are happy to work with litigation funders.

We also advise directors of companies where there are concerns about the solvency of the company and assist with any formal restructuring programme. We regularly work with licensed insolvency practitioners to advise and assist in such circumstances.
