Stuart Merrison joined Bishop & Sewell in 2015, having worked in London firms for a number of years. He has established a broad litigation practice in the Civil Courts, regularly conducting claims in the County Court, High Court and the Court of Appeal, with particular emphasis on property ownership (Gallarotti v Sebastianelli  EWCA Civ 865) and resolving disputes in the wider property field.
Stuart has over the years, advised on the many varied aspects of freehold property and is experienced in advising on rights of way, easements, boundaries, freehold covenants and party wall issues.
He additionally acts for both large and small private UK and overseas companies in resolving the various disputes that can arise for businesses. His expertise incorporates commercial building disputes, breach of contract, contract repudiation and termination, partnership related matters and agency disputes. He is also able to advise on professional negligence claims and issues arising out of professional conduct.
Commercial – Landlord & Tenant
Stuart acts for both landlords and tenants in all aspects of commercial property be they high profile, national companies or individual business owners and in particular conducts contested lease renewal claims under the 1954 legislation. His experience incorporates dilapidations claims and he is able to advise on service charge collection and arrears, forfeiture and relief, unauthorised alterations and use.
Residential – Landlord & Tenant
Stuart acts for both landlords and tenants in all aspects of residential leases, both short and long term including repossession of property, service charge disputes and disrepair and is able to advise on the procedure in both the First Tier tribunal, the Upper Tribunal and the Courts including reasonableness of service charge and defective lease terms. He regularly resolves issues arising out of missing landlords and has specialisms in Acquisition Order claims and litigation arising out of collective enfranchisement and lease extensions.
